4.3.2 the payment of the cost of having the products or services supplied again.

4.4 Except for the rights, guarantees and remedies which cannot be excluded, restricted or modified:

4.4.1 Lotus Insurance excludes all liability (including liability arising as a result of its negligence) for any indirect or consequential expenses, losses, damages or costs, loss of profit, lost revenue, business interruption and loss of data incurred or suffered by or awarded against you under or in any way connected with these Terms of Use; and

4.4.2 Lotus Insurance limits its liability in relation to any direct loss to $100.

  1. NOTICES AND ELECTRONIC COMMUNICATIONS

9.1 For the purposes of the Electronic Transactions (Queensland) Act 2001 (Qld) Lotus Insurance and the user consent to:-

9.1.1 any information required or permitted to be given in writing under a state law being given by an electronic communication;

9.1.2 any signature required to be given under a state law being given electronically using the procedures outlined on the Website;

9.1.3 any document required or permitted by a state law to be produced being produced electronically.

9.2 Transactions (Queensland) Act 2001 (Qld), both Lotus Insurance and the user irrevocably give that consent.

9.3 Without limiting clause 9.1.1. any notice required or permitted to be given under these Terms and Conditions may be given in any way allowed by law, including by way of email.

9.4 A notice sent by email transmission is effective upon receipt of confirmation of successful transmission to the recipient unless it is transmitted after the close of normal business hours, or on a Saturday, Sunday, public holiday or 27, 28 or 29 December, in which case it is effective on the opening of business on the next business day at the intended place of receipt.
